Bloomberg Law: Court Allows SEC To Keep Judges (Audio)
(Bloomberg) -- Peter Henning, a professor at Wayne State University, and Rob Tricchinelli, a legal editor for Bloomberg BNA, discuss a U.S. Appeals Court decision that allows the SEC's in-house judges to impose sanctions even though they are employed by the agency and not constitutionally appointed government officials. The internal court has come under increased scrutiny since the Dodd-Frank act expanded the agency's powers, as some argue that it is problematic for judges to answer directly to an agency.
